Supplementary Terms Insurances

  1. Subject

  2. These Supplementary Terms (“Terms”, “ST“) govern the business relationship between Weiss Group LLC (SARL) (“Weiss Group”) and its insurance clients, subject to any other special agreements.
  3. These Terms supplement the General Terms and Conditions (“GTC“) and the Supplementary Terms and Conditions (“STC“) Financial Services of Weiss Group or take precedence in case of contradictory provisions. The GTC and the STC form an integral part of these Terms.
  4. Collaboration and duties to cooperate

  5. When recording an insurance application, the client is obliged to truthfully provide or pass on all information regarding personal and factual details to Weiss Group. In particular, the accuracy of the client's statements regarding health issues is indispensable.
  6. Failure to disclose facts or illnesses may result in a breach of the duty of disclosure. As a result, the insurance company will provide no or reduced benefits in the event of a claim and will withdraw from the contract with immediate effect.
  7. Weiss Group undertakes to diligently verify the legitimacy of the client and the authorized representatives. The damage resulting from the non-recognition of legitimacy defects and forgeries or deceptions shall be borne by the client, provided that Weiss Group has exercised the usual diligence customary in business.
  8. The client is obligated to cooperate. If a fact of risk changes (e.g. location, activity, sum insured, etc.), the client undertakes to inform Weiss Group without delay. The same applies to new facts of risk.
  9. Weiss Group must be notified immediately if the client discovers errors in an insurance policy. If damages occur due to the client's omission, Weiss Group shall not be liable.
  10. Duty to inform

Weiss Group is neither legally nor economically nor in any other way bound to an insurance company and, pursuant to the Federal Act on the Supervision of Insurance Undertakings (Insurance Supervision Act, ISA, Art. 43 para. 1), is registered in the register of the Swiss Financial Market Supervisory Authority FINMA under number 33312.
  12. The provisions of the Federal Act on the Supervision of Insurance Undertakings (Insurance Supervision Act, ISA), in particular Art. 45, and the Ordinance on the Supervision of Private Insurance Undertakings (Supervision Ordinance, SO), in particular Art. 190, apply.
  13. Liability

  14. If claims for damages arise from the activity as an insurance intermediary, Weiss Group shall be liable within the scope of its professional liability pursuant to the Federal Act on the Supervision of Insurance Undertakings (Insurance Supervision Act, ISA).
  15. In the event that no insurance company is liable for justified claims for damages arising from the mediation activities of Weiss Group, Weiss Group has a professional liability insurance with Allianz Suisse with a coverage of 2 million Swiss francs in accordance with the provisions of the Federal Act on the Supervision of Insurance Undertakings (Insurance Supervision Act, ISA), Art. 45, paragraph d.
